1. Agreement to these Terms

These Terms of Use (the "Terms") apply to your use of MartialArtsRobots.com and any of its pages (the "Site"). The Site is run by [operator's name or company: add before publishing] ("we", "us", "our"). By opening or using the Site, you agree to these Terms. You also agree to our Disclaimer, which forms part of these Terms. The Privacy Policy and Cookie Policy are notices that explain how information and storage on your device are handled. They are not terms you accept, and using the Site is not consent to anything in them. If you do not agree to these Terms, please do not use the Site.

2. What the Site is, and what it isn't

The Site is a free, non-commercial parody and entertainment website. It shows a 3D animation of fictional robots performing kicks and punches, with jokes, sound effects and flying microchips.

The Site is not a martial arts course, class or training program. It does not provide martial arts, self-defense, fitness, medical, safety or legal instruction or advice, and it does not award real ranks, belts or qualifications. The Disclaimer explains this in detail. If anything on the Site seems to say otherwise, the Disclaimer and these Terms take priority.

3. Who may use the Site

You may use the Site if you are old enough to accept these Terms where you live. If you are not, you may only use the Site with the permission and supervision of a parent or guardian, who accepts these Terms on your behalf and is responsible for your use of the Site.

4. Acceptable use

You agree to use the Site only for lawful, personal and non-commercial entertainment. You agree not to:

• use anything on the Site to hurt, threaten, harass or intimidate anyone, or as a reason to kick, strike or spar with a person or an animal;
• present the Site, its content or its robot belt ranks as real martial arts instruction, training, grading, certification or advice, or suggest that we endorse you, your school or your product;
• try to break, overload, probe, scan or get unauthorized access to the Site, its server or its code, or interfere with other people's use of it;
• copy, scrape, reproduce, republish, sell or redistribute the Site or substantial parts of it except as allowed in section 6 or by law;
• use the Site in any way that breaks a law or regulation that applies to you.

5. Physical activity: assumption of risk and release

You understand that the Site is not instruction and that martial arts and other physical activities carry inherent risks of injury, some of them serious. We ask you not to attempt any movement shown or described on the Site. If you choose to do so anyway, you do so voluntarily, at your own risk and under your own responsibility, including responsibility for your health, fitness, surroundings, equipment and supervision.

To the fullest extent permitted by law, you release us from all claims, demands and liability arising out of or relating to any injury, illness, death, loss or damage that results from you or anyone else attempting a movement shown or described on the Site.

6. Intellectual property

The Site and its content are owned by us or our licensors and, to the extent the law protects them, protected by copyright and other laws. The content includes the code, 3D models, animations, robot characters, sounds, text, design and the MartialArtsRobots name and logo. Third parties keep any rights they have. We give you a personal, revocable, non-exclusive and non-transferable permission to view and use the Site in your browser for your own entertainment. You may share links to the Site. Any other use needs our written permission, except where the law allows it without permission, for example fair use or fair dealing.

Reporting an infringement or a mistake. If you believe something on the Site infringes your rights, or that something on it is wrong, write to contact@martialartsrobots.com with enough detail for us to find it. We will look into every report and may change or remove the material.

7. Third-party names and trademarks

The names of martial arts, styles and techniques are used only to describe the robots' moves, as commentary and parody. Any third-party trademarks belong to their owners. Their appearance on the Site does not mean that those owners are connected to the Site, sponsor it or endorse it, or that we are connected to them.

8. No warranties

To the fullest extent permitted by law, the Site and all of its content are provided "as is" and "as available", without any warranty of any kind, whether express, implied or statutory. This includes any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, completeness, reliability, safety, availability, security and non-infringement.

We do not promise that the Site will be accurate or complete, work without interruption or errors, be free of viruses or other harmful components, or work on your device. Some places do not allow certain warranties to be excluded, so some of these exclusions may not apply to you.

9. Limitation of liability

To the fullest extent permitted by law, we and our contributors, suppliers and hosting providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages. We will not be liable for any loss of data, profits, revenue, goodwill or opportunity. We will not be liable for any personal injury, illness, death or property damage arising out of or relating to the Site, its content or any attempt to perform a movement shown or described on it. This applies whatever the legal theory, even if we were told such damage was possible.

To the fullest extent permitted by law, our total liability for all claims relating to the Site is limited to the greater of the amount you paid us to use the Site in the twelve months before the claim, which is zero because the Site is free, and ten US dollars (USD 10).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you. In some places, that includes liability for death or personal injury caused by negligence, and liability for fraud. If you use the Site as a consumer, you keep any mandatory rights that consumer law gives you.

10. Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold harmless us and our contributors, suppliers and hosting providers from and against any claims, losses, damages, liabilities, costs and expenses, including reasonable legal fees, that arise out of or relate to:

• your misuse of the Site or breach of these Terms;
• you, or anyone acting at your suggestion, attempting a movement shown or described on the Site;
• you presenting anything from the Site as real instruction, advice or a credential.

11. Availability and changes to the Site

The Site is a hobby project. We may change, pause or remove any part of it, or the whole Site, at any time. Temporary interruptions, maintenance and faults need no notice. If we decide to close the whole Site for good, we will try to say so on the Site beforehand, where circumstances allow. The Site has no accounts, so we have no other way to reach you. We have no obligation to keep it online, update it or fix it.

We are not responsible for delays, faults or interruptions caused by things outside our reasonable control. Those include a fault or outage at our hosting provider, a failure of communications networks, a cyber attack, an infrastructure failure, a change to your browser or operating system, and an order of a competent authority.

12. Changes to these Terms

We may update these Terms at any time. The date at the top shows when they last changed. A significant change will be announced on the Site in a reasonably prominent notice before it applies, where practicable, and no change applies to anything that happened before it. The version that applies is the one published at martialartsrobots.com. A copy kept by your browser, such as a tab left open, may be older. If you keep using the Site after an update, you accept the new Terms. If you don't agree with them, please stop using the Site.

13. Governing law and disputes

These Terms make no choice of a governing law and give no court exclusive jurisdiction. Which law applies, and which courts may hear a dispute about the Site or these Terms, is decided by the ordinary rules of private international law that apply to you.

Nothing in these Terms takes away the protection of mandatory consumer law that applies where you normally live and that cannot be set aside by agreement. In particular:

• European Union: if you use the Site as a consumer and live in an EU Member State, you may bring proceedings in the courts of the country where you live, and you may be sued only there, where Articles 17 to 19 of Regulation (EU) No 1215/2012 (Brussels I bis) apply.
• United Kingdom: if you use the Site as a consumer and live in the UK, you keep the protection that mandatory UK consumer law gives you, including its rules on which courts may hear a claim.
• United States: if you use the Site as a consumer and live in the US, you keep any right that the mandatory consumer law of your state gives you.

Where this section conflicts with such a protective rule, the protective rule prevails.

Time limit for claims. To the extent the applicable law allows an agreed period, a claim connected with the Site must be brought within one year of the event that gives rise to it. This does not shorten any limitation period fixed by mandatory law, and in particular any period that consumer law fixes for you. Where such a period applies, it prevails over this paragraph.

14. General terms

• Whole agreement. These Terms and the Disclaimer are the whole agreement between you and us about the Site. The Privacy Policy and the Cookie Policy explain how we handle information and storage on your device.
• Survival. Sections 5, 8, 9, 10 and 13, and the Disclaimer, continue to apply after you stop using the Site and after the Site closes.
• Severability. If a court finds any part of these Terms invalid or unenforceable, that part is limited as little as necessary, and the rest stays in force.
• No waiver. If we do not enforce a right straight away, we have not given it up.
• Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example if the Site gets a new operator.
• Headings. Headings and the short summaries are for convenience only. They do not limit what the sections say.
